Some say we are embarking on a Big Data era. IBM has reported that we create 2.5 quintilion bytes of data every day, and that 90% of the digital data that exists today has been created in the last two years. A huge amount of data about individuals’ habits, behavior and personal preferences are now being created (e.g. via smartphones, social media platforms, payment services and loyalty schemes, machine-to-machine interconnectivity and the Internet of Things (“IoT”), software-as-a-service and cloud applications). In addition, new technology tools are enabling companies to make more of existing data stored in legacy systems. Not only do organizations have access to more data than ever before, there are more tools for managing, manipulating and using that data.
It has been acknowledged for some time that Big Data and IoT technologies and analytics can drive big benefits for companies in terms of efficiencies and revenue creation. However, for all the potential benefits, Big Data and IoT also pose challenging legal issues that need to be navigated carefully. In particular, the ability to collect so much data from so many sources and the ability to use that data in a myriad of ways (including ways never originally envisaged when the data was collected), creates huge privacy implications.
